Preamble

While becoming a Gullivearth.com’s member, you promise to respect the terms of use. If you do not accept these terms of use, you must not sign up for Gullivearth.com. Registering to one or several services as well as using this site mean the member agree totally to these terms.

Article 1 - Registration

You have to be of age and to fill in all the compulsory fields in the registration form to become member of Gullivearth.com.

The equipments (computer, software, communication mediums, etc.) enabling access to the services of Gullivearth.com are at your own expenses, as well as the telecom expenditure generated by using those services.

You guarantee that the data you give to us are exact and accurate. You promise to give a real e-mail address which really belongs to you. You commit yourself not to complain or sue Your World Famous in the event of not receiving the messages that Gullivearth.com could have sent to you.

After signing up, you will have one or several personal and confidential username(s) and password(s). You must not tell or share them to anybody. Gullivearth will under no circumstances be held responsible if you lose your usernames and/or passwords.

If you use these elements not on purpose, Gullivearth reserves the right to cancel your account without notice. You would be the only responsible if others use your account and for the actions or for the statements made through your account, whether they are fraudulent or not. You commit yourself not to complain or sue Your World Famous in that event.

Since Gullivearth.com is not in a position to verify the identity of people who sign up to its services, it shall not be held responsible in the event of an impersonation by a member. If you think that somebody uses your account or your identity, you have to notice us immediately by letter to the above-mentioned address.

When a member wants to refer a friend and give the name and address of the latter, he promises to have beforehand got the approval of this friend regarding the processing of these data by Gullivearth.com. The member is also completely responsible towards his/her friends, Gullivearth.com and others members for the consequences of giving his/her friends'names and address to Gullivearth.com.

Article 2 - Using Gullivearth.com

Once you have signed up, you have access to the services of Gullivearth.com.

When using the services of Gullivearth.com, you commit yourself in particular to respect the following rules:

- you have to comply with the laws in effect and to respect the other members'rights as well as these Terms of use,

- you have to behave loyally towards Gullivearth.com and the others members,

- you have to respect the patent rights pertaining to the contents provided by Gullivearth or by others members,

- you should never transfigure a functionality of Gullivearth from its initial purpose,

-you should never overload the service in any way. In particular, do not upload more than 1.000 pages on Gullivearth.com in a day without our written approval.

-only tell to Gullivearth.com and to other members the pieces of information whose diffusion shall not be prejudicial to you.

-do not publicize any information or contents which are not accurate, or might infringe or violate someone else’s rights.

-do not publicize any information or contents which infringes or violates others members' rights or which are libellous, offensive, obscene, abusive or encouraging violence, political, racist or xenophobic and, generally, any contents contrary to the purpose of Gullivearth.com, to the laws and rules in effect or to good morals,

-do not publicize information or contents which hamper, disrupt or prevent the normal use of Gullivearth.com, of break off and/or impede the normal traffic of communications between members,

-do not directly or indirectly take part in putting in place or developing a network aiming at using patterns similar to sales or snowball sales in accordance with articles L122-6 and L122-7 in the Code of Consumption of the French Republic,

-do not directly or indirectly take part in putting in place or developing a network aiming at using patterns similar to sales organisation ("MLM"). It is also forbidden to hire a domestic dealer ("VDI") to create this kind of organisation or using others similar patterns,

-If tone member breaks one or several of this rules, Gullivearth.com reserves the right to disable his/her account, to automatically delete the contentious messages, to prevent his/her whole profile or a part of it to be publicized, and/or to block this member's access to all the services or a part of them, temporarily or definitely, without any compensation,

-Gullivearth.com shall not be held liable ore responsible for false statement or any misconduct from a member. Gullivearth.com relieve itself of any responsibility about meeting between members of Gullivearth.com, in Gullivearth.Com or during meeting between members and non-members, in reference to its site and its services.

Article 3 - Privacy

Your privacy is important to Gullivearth.com and Your World Famous SAS. In this regards, and in accordance with the French data protection act of the 6 janvier 1978, you have the right to access, modify, rectify and delete the data related to you. You can exercise this right by sending a letter to the back-office to the address below:

Gullivearth is the only decision-maker regarding the contents publicized on Gullivearth.com and can decide unilaterally not to publicize or to delete a campaign if it contrevene the rules mentioned above. The responsibility of Gullivearth.com shall not be held responsible in this regards.

Article 4 - Confidentiality of your data

Some data, indications or contents (especially pictures) that users can provide if they want are likely, under the responsibility of the interested member, to give away the ethnic origin of the user, his/her nationality and/or his/her religion. When publicizing such pieces of information, which are all optional, the user shows his/her wish and consequently his/her definite approval too for the treatments of these data considered as sensitive by Gullivearth.com and voluntarily takes the whole responsibility.

The data which are likely to be collected in Gullivearth.com are only aimed at enhancing your social network.

The data you give are used to provide you our services. All precautions have been taken to file these data in a secured environment. The data that we collect are not to be transmitted to other people, nor sold or traded.

Trademarks, logos, graphic design, pictures, videos and texts on the website Gullivearth.com are Gullivearth.com's and its partners' intellectual properties They shall not be reproduced, used or presented without Gullivearth.com's express permission, offenders will be prosecuted.

The right to use Gullivearth is only conceded to you in the digital form on your computer in order to see the pages you consult with your browser. You can print these pages as a private copy for your own use according to article L. 122-5-2° of the French intellectual Property Law. Any other use is forbidden without Gullivearth.com's express permission.

Article 6 - Termination

Terminating your account and its personal data will only be in effect within 24h.

Gullivearth.com shall not be held responsible for the accuracy or inaccuracy of the data and contents provided by the members, the visitors of the site and/or yourself. Gullivearth.com shall also not be held responsible for the contents publicized by a member which could contrevene the rights of one or several members. In particular, it is up to the users to verify that they do not contrevene to any intellectual property right when publicizing a content, including the photographies.

The quality of the site www.gullivearth.com expected both by Gullivearth.com and by its members requires the members to respect a certain code of ethics in expression and behaviour, others members rights, as well as the laws and rules in effect. In order to carry out this demand for quality, for personnal responsibility and for ethics, Gullivearth.com enables any member to report the data (photographies, texts...), the behaviour or the comments from another user in the site www.gullivearth.com if s/he considers they harm the rules and laws in effect, the image or the purpose of Gullivearth.com, the rights of others members, or the good morals. In consequence, the members recognize and accept that the data they give, their comments and their behaviour are likely to be reported by others members or moderated and/or modified by Gullivearth.com on the basis of objective criteria. If the data, photographies or comments that have been reported turn out to breach the laws and rules in effect or the member's contractual obligations, the disposal of the Terms of Use, especially the article 5 - "Termination of account" can be implemented.

If the responsability of Gullivearth.com was sought in consequence of any breaching by a member to the obligations s/he lies with according to the law or to these Terms of use, the latter promises to guarantee Gullivearth.com against any conviction pronounced against it. The promise includes both the indemnity which could have to be payed and the lawyers' fees and legal costs which would be at the member's expense.

Article 8 - Gullivearth.com's functioning

You must have the competences, the devices and the software required to use Internet and you recognize that the characteristics and the constraints of Internet make it impossible to guarantee the security, the availability and the integrity of the transmission of data on Internet.

Gullivearth.com does not guarantee that the services will operate without any discontinuation or miss of functioning. In particular, their operation could be momentarily interrupted because of maintenance operations, updating, or technical improvements, or to modify the site's contents and/or presentation.

As far as possible, Gullivearth.com will acquaint its members before a maintenance or updating operation. You renounce to seek Gullivearth.com's responsibility by means of the site's functioning or operating.

You shall not seek Gullivearth.com's responsibility in the event of a malfunctioning, an impossibility to access the site, or bad conditions of using the site attributable to an unadapted equipment, disturbances chargeable to the member's service provider, an obstruction of the network, and/or for any reason non related to Gullivearth.com.

Under no circumstances, Gullivearth shall be held liable for indirect damages, notably the loss of data (copies included) or of savings that you could have done.

Article 9 - Modification on Gullivearth.com

Gullivearth reserve the right to modify or develop the pages of www.gullivearth.com, the services or the Terms of Use which are related to it at anytime.

These modifications will come into force as soon as they are publicized in the site www.gullivearth.com without prejudice to the possibility for any member to terminate his/her membership.

Failing this, you will be considered as having accepted these modifications by continuing to use the site www.gullivearth.com. The members are invited to refer to the latest version online. The presence of the member in the site means his/her full approval of any revision or modification of the site www.gullivearth.com

Article 10 - Applicable law - Assignment of jurisdiction

The Terms of use are governed, interpreted and applied in accordance with the French law, they shall be interpreted in French in the event of contestation about a word's meaning or about a provision of these Terms of Use.

Subjected to the legal provisions of law and order enforceable when it comes to jurisdictional competence, the courts within the jurisdiction of the head office of Gullivearth.com are the only one competent to deal with any litigation related to the Terms of Use, including, without this enumeration being limited, their validity, their interpretation, their execution and /or their termination and its consequences.
